UK Passport Holder - Tax Question

    Hi vegas fanatics long term lurker,just a quick question.Last year in paradise i won 1400 on poker machine and they the casino (westgate) withheld 411 dollars for tax.Firstly can i get this back at all.Secondly ive read uk passport holders have won and not been taxed at all due to some treaty any advice much appreciated.

    Hi - I have had a few hand pays and never been deducted US tax. First time at Aria they look my passport and gave me some paperwork and said an ITN (International Tax Number) would be sent separately and paid the hand pay in full.

    A while later I received this in the post when back in the UK.

    When I hit other hand pays I showed them a picture of my ITN and gave some ID and have not had any further deductions.

    No idea how you would go about getting your deduction back - assume you may have to put in a US tax return or similar?

    This is how it's supposed to work. Casinos have the ability to obtain an ITIN for you the first time you get a handpay, and then they don't have to withhold any tax. And then on any future handpays, you give them your ITIN. Not all casinos bother doing it though.

    You should be able to get a refund of the withholding, but you'll have to submit a form to the IRS. Probably you submit to them to get an ITIN and get the refund at the same time. I don't know the exact form or process, but if you Google search you can probably find out. Or someone here may be able to tell you.

    @Rubos What the casino actually did was file a form W-7 on your behalf. They would have asked you to sign the form and the slot manager would have notarized your ID. Once the application is made they can pay you in full even though you don't yet have an ITIN. Unfortunately not all casino's have the IRS trained staff to do this and they will withhold regardless of treaties.

    In order to recover the tax you only need to file form 1040nr and include your 1042-s from the casino. You cannot file this form though unless you already have an ITIN.
